ORDINANCE NO. 57, FOURTH SERIES

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LUVERNE TO AMEND CITY CODE CHAPTER 118. CANNABIS BUSINESS REGULATIONS

THE CITY OF LUVERNE DOES HEREBY ORDAIN:

SECTION 1. That Section 118.10 Application Approval is hereby amended as follows (new material is underlined; deleted material is lined out):

118.10 Application Approval

(A) A state-licensed cannabis retail business application for registration shall not be approved or renewed if the applicant is unable to meet the requirements of this chapter. No application for registration shall be approved if such business would result in non-compliance.

(B) A cannabis retail business application for registration shall not be approved if the cannabis retail business would exceed the maximum number of cannabis retail business registrations permitted under Section 118.20. The City shall process cannabis retail business registration applications in the order in which the applications are received until the maximum number of registered cannabis retail businesses has been met.

(C) A state-licensed cannabis retail business application that meets the requirements of this chapter shall be approved, provided that such approval shall not result in the City exceeding the maximum number of registered cannabis retail businesses as set forth in this chapter.

Section 2. That Section 118.20 Limiting of Registrations is hereby amended as follows (new material is underlined; deleted material is lined out):

118.20 Limiting of Registrations

(A) The City shall not limit the number of cannabis retail businesses or cannabis businesses with a retail endorsement in the City. Under M.S. § 342.13(h), the City may limit the number of cannabis retail business registrations issued by the City to no fewer than one cannabis retail business registration for every 12,500 residents. Pursuant to this authority, the City shall limit the number of cannabis retail business registrations to five (5), excluding medical cannabis combination businesses, lower-potency hemp edible retailers, or a potential municipal cannabis retail business. The City shall process cannabis retail registration applications in the order in which the completed registration applications are received.

Section. 3. This ordinance takes full force and effect seven (7) days after its publication.
