ORDINANCE NO. 46, FOURTH SERIES
AN ORDINANCE AUTHORIZING CONVEYANCE OF REAL ESTATE REGARDING
TRUNK HIGHWAY 75 PROJECT
(VARIOUS TRACTS CITY OF LUVERNE, ROCK COUNTY, MINNESOTA)
THE CITY OF LUVERNE DOES HEREBY ORDAIN:
SECTION 1. Pursuant to City Charter, Section 12.05, the City Council is authorized to sell or convey the following described real estate located in the City of Luverne, County of Rock, State of Minnesota, described as follows, to-wit:

All of the following:
That part of Lots 1 and 2, Block 5, PJ KNISS' ADDITION TO LUVERNE, shown as Parcel 13 on Minnesota Department of Transportation Right of Way Plat Numbered 67-06 as the same is on file and of record in the office of the County Recorder in and for Rock County, Minnesota;
together with other rights as set forth below, forming and being part of said Parcel 13:
Temporary Easement:
A temporary easement for highway purposes as shown on said plat as to said Parcel 13 by the temporary easement symbol, said easement shall cease on December 1, 2029, or on such earlier date upon which the Commissioner of Transportation determines by formal order that it is no longer needed for highway purposes.
And
All of the following:
That part of Lots 19 and 20, Block 7, WARREN AND KNISS' ADDITION TO THE VILLAGE OF LUVERNE, shown as Parcel 15 on Minnesota Department of Transportation Right of Way Plat Numbered 67-06 as the same is on file and of record in the office of the County Recorder in and for Rock County, Minnesota;
together with other rights as set forth below, forming and being part of said Parcel 15:

To State of Minnesota
Sec. 2. The Mayor and City Administrator are hereby authorized and directed to execute such legal documents as are necessary to accomplish this sale and are further authorized to execute and deliver a warranty deed upon complete fulfillment of all terms and conditions.
Sec. 3. This ordinance takes full force and effect seven (7) days after its publication.
