Rock County Board of Commissioners          9:00 A.M.

Herreid Board Meeting Room/Zoom Video Meeting September 22, 2020

The meeting was called to order by Chair Overgaard with all Commissioners present.  Also in attendance were County Attorney Jeff Haubrich, County Administrator Kyle Oldre and Star-Herald Reporter Mavis Fodness.

The Pledge of Allegiance was recited by all who were in attendance. 

Motion by Reisch, seconded by Burger, to approve the September 22, 2020, County Board agenda, declared carried on a voice vote.

Motion by Burger, seconded by Williamson, to approve the September 08, 2020, County Board minutes, declared carried on a voice vote.

Motion by Williamson, seconded by Reisch, to approve the Consent Agenda, declared carried on a voice vote.

1. Raycom Maintenance contract - $7,771.76

2. Hildi Contract - $3,800 for actuarial reporting including all information required by the GASB Statements for January 01, 2020 – December 31, 2021

Ashley Kurtz, Auditor/Treasurer, presented the claims; motion by Reisch, seconded by Burger, to approve the claims, declared carried on a unanimous vote.

The County Board was in receipt of the Fund Balance report; motion by Overgaard, seconded by Reisch, to approve, declared carried on a voice vote.

The Auditor/Treasurer presented Resolution No. 17-20, authorizing a previous property owner to repurchase the tax forfeited property as per Minnesota Statutes 282.241. The property is located in the City of Hills and identified as parcel 15-0136-000; the County Administrator also stated that the City of Hills Mayor also supported the request. Motion by Burger, seconded by Williamson, to approve Resolution No. 17-20, declared carried on a voice vote.

Motion by Reisch, seconded by Overgaard, to approve an additional expenditure from the CARES Act funds to the Jasper First Responders up to $7,500 for equipment upgrades in response to COVID-19, declared carried on a voice vote.

Motion by Burger, seconded by Thompson, to approve lost warrant #97859 for $960.00 payable to MN Pollution Control Agency, declared carried on a voice vote.

The Auditor/Treasurer and Administrator led a discussion regarding setting the preliminary levy for 2021. After discussion, motion by Reisch, seconded by Burger, to set the preliminary levy at $6,345,106, a 2.5% increase, declared carried on a voice vote.

Melissa Schmidt and Jerome Duehr, representatives of the Elk Creek Solar LLC, presented a review of the development agreement between Elk Solar LLC and Rock County; purpose of the review was meant only to be introductory and will request approval at a later date.  Comments from Eric Hartman, Planning & Zoning, Mark Sehr, Engineer, and Jeff Haubrich were that there are no initial issues with the development agreement as most of the conditions are regulated through the conditional use and state permitting process. There was also a request to make available the road agreements with Vienna and Magnolia townships.

The County Board was in receipt of the Walleye Wind Decommissioning Plan and a request to approve the decommissioning plan which includes dismantling turbine components and transporting offsite and salvage and resale values; all decommissioning costs are the responsibility of Walleye Wind, LCC. There was a question of the decommissioning plan for the (7) MinnWin turbines purchased by Walleye Wind; motion by Williamson, seconded by Burger, to table action until next meeting, declared carried on a voice vote.

Motion by Williamson, seconded by Burger, to approve a 1-year law enforcement contract extension with the City of Luverne with a 5% increase, declared carried on a voice vote. The County Board requested the County Attorney to draft that contract.

The Administrator informed the County Board that Rock County has been selected by the Minnesota Department of Health to conduct community testing on October 13-15 in an effort to find new positive cases to help prevent community spread.

Commissioner Reisch stated that he attended the following meetings: Community Library, Southwest MN Opportunity Council, bike path. 

Commissioner Thompson stated that she attended the following meetings:  Southwest Regional Development Commission, AMC Fall Policy meeting, Southwest Health & Human Services, Private Industry Council Chief Elected Officials Board.

Commissioner Williamson stated that he attended the following meetings:  Rural Water, One Watershed One Plan, Southwest Mental Health.

Commissioner Burger stated that he attended the following meetings: Luverne Township, Southwest Health & Human Services, MinnWest Lenders Farm Crisis event

Commissioner Overgaard stated that he attended the following meetings:  Magnolia Township, AMC Environmental Policy meeting, Kenneth City Council, Bike path meeting.

With no further business to come before the County Board, motion Reisch, seconded by Williamson, to adjourn, declared carried on a voice vote.
