OFFICIAL SUMMARY OF ORDINANCE NO. 14, FOURTH SERIES

AN ORDINANCE GRANTING CENTERPOINT ENERGY RESOURCES CORP., d/b/a CENTERPOINT ENERGY MINNESOTA GAS (“CENTERPOINT ENERGY”), ITS SUCCESSORS AND ASSIGNS, A NONEXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN FACILITIES AND EQUIPMENT FOR THE TRANSMISSION, DISTRIBUTION AND SALE OF GAS ENERGY FOR PUBLIC AND PRIVATE USE AND TO USE THE PUBLIC WAYS AND GROUNDS OF THE CITY OF LUVERNE, ROCK COUNTY, MINNESOTA, FOR SUCH PURPOSE; AND, PRESCRIBING CERTAIN TERMS AND CONDITIONS THEREOF.

On October 27, 2020, the City of Luverne, Minnesota (“City”) adopted an Ordinance granting a Gas Energy Franchise to CenterPoint Energy. The Ordinance serves two purposes. First, it is intended to provide for and specify the means to attain the best possible gas energy service for the public by providing requirements for gas energy with respect to technical standards and related matters.  Second, it grants a non-exclusive gas energy franchise to CenterPoint to operate, repair and maintain a gas energy system within the City and contains specific requirements for CenterPoint to do so.

The Ordinance includes the following: 1) imposes on CenterPoint a franchise fee; 2) establishes a franchise term of twenty (20) years; 3) locating facilities, street openings, restoration, and relocation requirements of CenterPoint Energy; and 4) right-of-way permitting requirements of CenterPoint Energy.

It is hereby determined that publication of this title and summary will clearly inform the public of the intent and effect of Ordinance No. 14, Fourth Series. A copy of the entire Ordinance shall be posted at the Luverne City Offices.

It is hereby directed that only the above title and summary of Ordinance No. 14, Fourth Series be published, conforming to Minn. Stat. §331A.01, with the following:
