ORDINANCE NO. 13, FOURTH SERIES

AN ORDINANCE AUTHORIZING CONVEYANCE OF REAL ESTATE

(PORTIONS OF OUTLOT SIXTEEN OF KNISS OUTLOT,

CITY OF LUVERNE, ROCK COUNTY, MINNESOTA)

THE CITY OF LUVERNE DOES HEREBY ORDAIN:

SECTION 1. Pursuant to City Charter, Section 12.05, the City Council is authorized to sell or convey the following described real estate located in the City of Luverne, County of Rock, State of Minnesota, described as follows, to-wit:

That portion of Outlot Sixteen (O.L. 16) of the Kniss Outlot Annex to the City of Luverne, Minnesota and of the abandoned railroad right-of-way lying west of said O.L. 16, all within the Southwest Quarter (SW 1/4) of Section Eleven (Sec. 11), Township 102 North, Range 45 West of the 5th P.M., within the incorporated limits of the City of Luverne, Rock County, Minnesota, described as follows:

Commencing at the Southwest Corner of said Section 11; thence North 90 degrees 00 minutes 00 seconds East (assumed bearing) along the south line of said SW 1/4 of said Sec. 11 for a distance of 321.16 feet; thence North 07 degrees 47 minutes 59 seconds West for a distance of 33.31 feet to the Southwest Corner of said O.L. 16; thence North 07 degrees 47 minutes 59 seconds West along the west line of said O.L. 16 for a distance of 470.00 feet to the Point of Beginning; thence North 82 degrees 12 minutes 01 seconds East for a distance of 44.13 feet; thence North 07 degrees 53 minutes 57 seconds West for a distance of 225.07 feet; thence South 81 degrees 53 minutes 07 seconds West for a distance of 43.74 feet to the west line of said O.L. 16 and to the easterly right-of-way line of the abandoned Chicago, St. Paul, Minneapolis and Omaha Railway Co. (CSMO RR); thence continuing South 81 degrees 53 minutes 07 seconds West for a distance of 58.50 feet to a point which lies 8.50 feet westerly (measured at right angles) from the former centerline of said CSMO RR Spur Track No. 21; thence South 07 degrees 47 minutes 59 seconds East, parallel with said former centerline CSMO RR Track No. 21 for a distance of 224.50 feet; thence North 82 degrees 12 minutes 01 seconds East for a distance of 58.50 feet to the Point of beginning, containing 23,025 square feet, of which 9882 square feet are within said O.L. 16 and 13,143 square feet are within said abandoned CSMO RR right-of-way.

That part of Outlot 16 in Kniss’ Outlot Annex to the Village (now City) of Luverne, Rock County, Minnesota, described as follows:

Commencing at the Southwest Corner said Outlot 16; thence North 07 degrees 47 minutes 59 seconds West on the west line of said Outlot 16 for a distance of 364.70 feet; thence North 90 degrees 00 minutes 00 seconds East for a distance of 104.00 feet to the west line of a tract described in the Warranty Deed recorded in Doc. No. 135368, Rock County Land Records Office and to the Point of Beginning; thence continuing North 90 degrees 00 minutes 00 seconds East for a distance of 96.00 feet to the east line of said tract; thence North 07 degrees 47 minutes 59 seconds West on said east line for a distance of 5.30 feet to the Northeast Corner of said tract; thence North 90 degrees 00 minutes 00 seconds West on the north line of said tract for a distance of 96.00 feet to the Northwest Corner of said tract; thence South 07 degrees 47 minutes 59 seconds East on the west line of said tract for a distance of 5.30 feet to the Point of Beginning, containing 504 square feet (0.01 acres).

SEC. 2. The Mayor and City Administrator are hereby authorized and directed to execute such legal documents as are necessary to accomplish this sale and are further authorized to execute and deliver a warranty deed upon complete fulfillment of all terms and conditions.

SEC. 3. This ordinance takes full force and effect seven (7) days after its publication.
